Terms and Conditions — brahmāṇḍ

These Terms and Conditions (“Terms”) are a binding agreement between you and Brahmanda Digital FZC (“brahmāṇḍ”, “we”, “us”) and govern your use of the brahmāṇḍ apps, websites, and services (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Important notice: guidance, not professional advice
brahmāṇḍ provides Vedic astrology content, readings, consultations, and ritual (pooja) services for personal guidance, reflection, and cultural and spiritual purposes only.
- The Service is not a substitute for professional advice. It does not provide medical, psychological, legal, financial, tax, or other professional advice, and must not be relied on as such.
- Astrology is interpretive. We make no guarantee of accuracy, outcomes, or results, and no claim that any reading, remedy, ritual, or consultation will produce any particular effect.
- You are solely responsible for the decisions and actions you take. Always consult a qualified professional (for example a doctor, lawyer, or financial adviser) for important decisions, and seek emergency help where needed.
- The Service is intended for users aged 18 and over.
By using the Service you acknowledge and accept this notice.
2. Eligibility and accounts
- You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract.
- You are responsible for the accuracy of the information you provide, including your birth details, and for keeping your account secure. Readings depend on the birth details you enter; inaccurate details produce inaccurate readings.
- You are responsible for activity under your account. Notify us promptly of any unauthorised use.
3. The Service and tiers
brahmāṇḍ offers:
- a Free tier with general daily guidance and basic charts;
- brahmāṇḍ Plus, a paid subscription unlocking the full personalised experience (for example detailed readings, additional charts, and history);
- pay-per-use services, including live one-to-one consultations with astrologers and pooja ceremonies performed by priests.
We may add, change, suspend, or remove features at any time.
4. Practitioners (astrologers and priests)
- Consultations and poojas are delivered by astrologers and priests made available through the Service. They provide guidance based on their own knowledge and interpretation.
- You agree to interact respectfully. We may cancel or refuse a session for abusive, unlawful, or inappropriate behaviour.
- Practitioners do not provide professional (medical, legal, financial, etc.) advice, and Section 1 applies to everything they share.
- Astrologers and priests who provide services through the platform are independent providers and are additionally governed by a separate Partner/Practitioner Agreement with us. These Terms govern your use of the Service as a user.
5. Bookings, payments, prices, and taxes
- Prices are shown in the app and may be presented in your local currency, with settlement in the currency we operate in. Applicable taxes (for example 5% VAT) are added as shown at checkout.
- We compute the authoritative price on our servers. Payments for consultations and poojas are processed by our payment processor; brahmāṇḍ Plus purchases on mobile are processed by Apple (App Store) or Google (Google Play) under their terms.
- A booking reserves a time slot. We may hold a slot only for a limited window during checkout; if payment is not completed, the slot may be released.
- You authorise us (and the relevant store or processor) to charge your selected payment method for the amounts shown.
6. Subscriptions and auto-renewal (brahmāṇḍ Plus)
- brahmāṇḍ Plus is offered as an auto-renewing subscription (for example monthly or annual) and may include a free trial.
- On mobile, your subscription is billed and managed through your Apple or Google account. It renews automatically unless you cancel at least 24 hours before the end of the current period. Manage or cancel anytime in your App Store or Google Play account settings.
- If a free trial is offered and you do not cancel before it ends, you will be charged for the first paid period.
- Subscription refunds are handled according to the rules of the store you purchased through (Apple or Google).
7. Cancellations and refunds
- Consultations and poojas: Cancellations, rescheduling, no-shows, and refunds for these bookings are governed by our Cancellation & Rebooking Policy, which forms part of these Terms and is shown to you at checkout. In summary, cancelling 24 hours or more before the start time is fully refundable, cancelling between 2 and 24 hours before is 50% refundable, and cancelling less than 2 hours before (or not attending) is non-refundable; you may reschedule once, free of charge, if you do so 12 hours or more before the start time.
- If we or a practitioner cancel a confirmed session, you are entitled to a full refund or to reschedule.
- Where a paid booking cannot be fulfilled (for example a slot is taken before confirmation completes), we will automatically refund the affected payment.
- Statutory refund and withdrawal rights that apply to you under local law are not affected by this section.
8. Acceptable use
You agree not to:
- use the Service unlawfully or for any harmful, fraudulent, or abusive purpose;
- harass, threaten, or harm practitioners or other users;
- record, reproduce, or redistribute consultations or pooja sessions without consent;
- attempt to access accounts or data that are not yours, or interfere with, reverse-engineer, or disrupt the Service;
- resell or commercially exploit the Service without our permission.
9. Intellectual property
The Service, including its software, design, text, charts, and other content (excluding your own data and any third-party content), is owned by brahmāṇḍ or its licensors and is protected by intellectual property laws. We grant you a limited, personal, non-transferable, revocable licence to use the Service for your personal, non-commercial use. You retain ownership of the content you submit and grant us a licence to use it as needed to operate the Service.
10. Feedback
If you send us ideas, suggestions, or feedback about the Service, you grant us a perpetual, worldwide, royalty-free licence to use them without restriction or obligation to you. We are free to use feedback to improve the Service without compensation.
11. Third-party services
The Service relies on third parties (for example Apple, Google, our payment processor, and our calculation and video providers). Your use of those services may be subject to their terms, and we are not responsible for their acts or omissions.
12. Disclaimers
To the maximum extent permitted by law, the Service and all content, readings, remedies, consultations, and poojas are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, reliability, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any reading or outcome will be accurate or achieve any result. See Section 1.
13. Limitation of liability
To the maximum extent permitted by law:
- brahmāṇḍ and its officers, employees, practitioners, and providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising from or related to your use of (or inability to use) the Service or any reading, remedy, consultation, or pooja.
- Our total liability for any claim arising out of or related to the Service is limited to the greater of the amount you paid to us in the 3 months before the event giving rise to the claim, or USD 100.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms excludes liability that cannot be excluded by law.
14. Indemnification
You agree to indemnify and hold harmless brahmāṇḍ and its officers, employees, and providers from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your breach of these Terms or of any law or third-party right.
15. Suspension and termination
We may suspend or terminate your access at any time if you breach these Terms or use the Service in a way that may cause harm or legal exposure. You may stop using the Service and delete your account at any time. Sections that by their nature should survive termination (for example disclaimers, limitation of liability, indemnification, and governing law) will survive.
16. Changes to these Terms
We may update these Terms from time to time. We will post the updated version with a new “Last updated” date and, for material changes, provide additional notice. Your continued use after changes take effect means you accept the updated Terms.
17. Governing law and dispute resolution
These Terms are governed by the laws of the Emirate of Dubai and the federal laws of the United Arab Emirates, without regard to conflict of laws rules. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Dubai, United Arab Emirates, and the proceedings will be conducted in English.
18. Additional terms for Apple App Store (iOS)
If you obtained the app from the Apple App Store, the following also applies. To the extent it conflicts with the rest of these Terms, this section governs for the iOS app.
- Acknowledgement. These Terms are between you and brahmāṇḍ only, not with Apple. Apple is not responsible for the app or its content.
- Scope of licence. brahmāṇḍ grants you a non-transferable licence to use the app on any Apple-branded device you own or control, as permitted by the App Store Usage Rules.
- Maintenance and support. brahmāṇḍ, not Apple, is solely responsible for any maintenance and support for the app. Apple has no obligation to provide any maintenance or support.
- Warranty. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation, and any other claims, losses, or costs are brahmāṇḍ's responsibility.
- Product claims. brahmāṇḍ, not Apple, is responsible for addressing any claims relating to the app, including product-liability claims, claims that the app fails to meet a legal or regulatory requirement, and claims under consumer-protection or privacy law.
- Intellectual property claims. brahmāṇḍ, not Apple, is responsible for investigating and defending any claim that the app infringes a third party's intellectual property rights.
- Legal compliance. You represent that you are not located in a country subject to a US Government embargo or designated as “terrorist supporting”, and that you are not on any US Government list of prohibited or restricted parties.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
- Contact. For any questions, complaints, or claims about the app, contact brahmāṇḍ at contact@mybrahmanda.com.
19. Additional terms for Google Play (Android)
If you obtained the app from Google Play, your use is also subject to the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for the Service. Subscription billing, renewals, and refunds for brahmāṇḍ Plus on Android are handled by Google under its terms.
20. General
- Severability. If any provision is held unenforceable, the rest of these Terms remain in effect.
- No waiver. Our failure to enforce any right or provision is not a waiver of it.
- Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
- Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control (for example outages, network failures, natural events, or acts of government).
- Entire agreement. These Terms and the Privacy Policy and Cancellation & Rebooking Policy are the entire agreement between you and brahmāṇḍ about the Service.
- Electronic communications. You agree we may communicate with you electronically (in-app and by email), and that such communications satisfy any legal requirement to be in writing.
- Intellectual-property complaints. If you believe content on the Service infringes your intellectual property rights, contact us at contact@mybrahmanda.com with details so we can investigate.
